Judgment
These two petitions seek quashing of cross-FIRs, bearing no. 43/2026 and 24/2026, both registered by PS Sarita Vihar for offences under Section 115(2)/126(2)/351(2)/3(5) BNS. The quashings have been sought on the basis of compromise executed between the parties.
In furtherance of order dated 11.05.2026 passed in CRL.M.C. 2296/2026, the petitioner of that case filed CRL.M.A. 24038/2026 seeking to implead Mr. Amit Chadha as a party. The application is allowed and amended memo of parties dated 17.07.2026 is taken on record.
Learned APP for State submits that in view of nature of offence, some deterrent cost may be imposed on the petitioners and beyond that State has no objection. Statements of parties have already been recorded by the concerned Joint Registrar.
The private parties present today in court affirm that they have settled all their disputes and do not wish to continue the prosecution of the subject FIRs.
Having spoken with the private parties in Court, I am satisfied that it would be in the interest of justice not to push the parties through full dress trial. However, keeping in mind it to be a case of road rage, which can assume dangerous proportions and at times even fatal ramifications, I also find substance in the contention of prosecution side that some deterrent measure must be taken against the private parties so that they never resort to such violence ever in future.
In view of above circumstances, both these petitions are allowed and the subject FIRs No.43/2026 and 24/2026 of Police Station Sarita Vihar for offences under Section 115(2)/126(2)/351(2)/3(5) BNS and proceedings arising out of the same are quashed subject to each of the petitioners of these petitions depositing costs of Rs. 20,000/- online with www.bharatkeveer.gov.in within one week. The costs receipts shall be filed by each of the petitioners before the trial court where matter is stated to be already listed on 30.09.2026.
Copy of this order be sent to the trial court making it clear that if the above said cost is not deposited and the cost receipt is not filed, the trial against the defaulting petitioners/accused persons shall continue.
Accompanying applications also stand disposed of.
