Petitioners seek quashing of FIR No. 266/2025 of PS Shakarpur for offence under Section 110/351(2)/3(5) BNS on the ground that the parties have compromised the disputes.

State has no objection to this petition subject to imposing reasonable cost on the petitioners as deterrence so that they do not repeat such conduct. Statements of parties have already been recorded by the concerned Joint Registrar.

The respondents no. 2 & 3 are present in Court today and are identified by IO/HC Rinku Kumar. I have spoken with respondents no.2 & 3 in Hindi and it is stated by them that they have compromised all disputes with the petitioners. Respondents no.2 & 3 submit that they do not wish to continue prosecution of petitioners. It is also stated by them that they have voluntarily settled the disputes and are not interested in any compensation.

Having spoken with respondents no.2 & 3, I am satisfied that it would be in the interest of justice not to push the parties through full dress trial. However, keeping in mind the manner in which injuries were inflicted by the petitioners using a hammer, and also keeping in mind that the respondents no. 2 and 3 do not want any compensation, learned counsel for petitioners herself on instructions offers to deposit cost at the rate of Rs. 10,000/- each petitioner with DHCLSC, which shall act as deterrence in future so that they do not repeat such conduct.

Therefore, subject to each of the petitioners depositing with DHCLSC cost of Rs. 10,000/- within one week, the petition is allowed and FIR No. 266/2025 of PS Shakarpur for offence under Section 110/351(2)/3(5) BNS as well as proceedings arising out of the same are quashed.

Copy of this order be sent to the trial court with the directions that in case the said cost is not deposited within one week, trial shall continue against the petitioners.
