Judgment
ORDER
By Hon’ble Mr. Rajnish Kumar Rai, Member (J):-Heard, Shri A D Singh, counsel for the applicant and Shri Chakrapani Vatsyayan, counsel for the respondents.
The instant original application has been filed seeking following reliefs: -
“(i)Direct the respondents to appoint the applicant on the selected post and permit him to join the duty forthwith with all consequential benefits.
(ii)Direct the respondent no.1 to consider and decide the representation dated 30.04.2026 of the applicant pending before him for his grievance within stipulated time.
(iii)Grant such other relief for which the applicant might be found entitled to, in the facts and circumstances of the case.
(iv)Allow the original application with cost of the litigation in favour of the applicant from the respondents. ”
Learned counsel for the applicant submitted that the applicant had applied pursuant to Centralised Employment Notice (CEN) No.RPF 02/2024 for recruitment to the post of Constable (Executive) in the Railway Protection Force (RPF) and the Railway Protection Special Force. He submitted that the notification is silent with regard to the duties of these constable executives. It is submitted further that they are to be appointed as a Ministerial Staff under Rule 276 of the Railway Protection Force Rules, 1987 (RPF Rules), which are governed by the Railway Establishment Rule and the select list has been finalized; however, till date applicant has not offered the letter of appointment; in this pursuance he has moved the representation dated 30.04.2026 before competent authority. Therefore, he seeks the direction upon the respondents/competent authority to consider the grievance of the applicant by passing a reasoned and speaking order on his representation within a time bound manner.
Learned counsel for the respondents vehemently opposed the instant Original Application on the ground that the same is not maintainable before this Tribunal, as the case of the applicant pertains to the Railway Protection Force (RPF), which is governed by separate recruitment rules. He draws attention to the record and submitted that the applicant has one pending criminal case; on that account the offer of appointment letter has not been issued.
Considering the submission and from perusal of record, we are in opinion to disposed this original application, at admission stage, with direction upon the respondents/competent authority to consider the grievance of the applicant by deciding the pending representation of the applicant dated 30.04.2026 by passing a reasoned and speaking order, within a period of three months from the date of receipt of a certified copy of this order.
Accordingly, OA stands disposed of. No order as to costs.
