Judgment
By filing this writ petition, the petitioners have prayed for the following reliefs:-
"A) For issuance of an appropriate writ(s), order(s), direction(s), directing upon the respondents to make necessary corrections in the name of the petitioners in the Marksheet dated 30.07.2021, issued to their daughters namely Shubhi Rupak, by the Central Board of Secondary Education (Respondent No.1 & 2) for Senior School Certificate Examination, 2021, as also the Transfer Certificate dated 31.07.2021, issued by the Pentecostal Assembly School, Bokaro (Respondent No.3).
B) For issuance of an appropriate writ(s), order(s), direction(s), holding and declaring that the effect of corrections to be made in the Admit Card, as also, the Marksheet for AISSE, 2019, of the petitioner's daughter, pursuant to the order passed by this Hon'ble Court, shall flow automatically to the Marksheet, as also, the Transfer Certificate issued to the petitioner's daughter for the subsequent years, as well."
Heard learned counsel representing the petitioners and learned counsel representing the respondents.
It is the grievance of the petitioners that in the marks statement-cum-certificate of Senior School Certificate Examination, 2021 (Class-XII), conducted by the Central Board of Secondary Education (C.B.S.E.), and also in the Transfer Certificate furnished by the Principal of Pentecostal Assembly School, Bokaro Steel City, Bokaro, Jharkhand, both issued to their ward – Shubhi Rupak, their names have been wrongly mentioned as “Pushpa Sahay” in place of “Pushpa Prasad” (as Mother’s Name), and “Anjani” in place of “Anjani Kumar” (as Father’s Name).
It is also the case of the petitioners that there were exactly similar defects as aforesaid, in the Admit Card and marks statement-cum-certificate of All India Secondary School Examination (AISSE) 2019 (Class-X), issued by the C.B.S.E., but due to intervention of this Court, vide order dated 08.04.2022 in W.P.(C) No.4086 of 2020, names of these petitioners had been corrected as “Pushpa Prasad” and “Anjani Kumar”. A photo copy of marks statement-cum-certificate bearing No.2237762 dated 06.05.2019 / 01.07.2022, with the said correction, is also on record as Annexure-SA-1 to the Supplementary Affidavit.
The petitioners thus pray that since the same Board i.e. C.B.S.E. had made corrections in the certificates of Class-X of their ward, same corrections should have been carried on, in respect of the certificates of Class-XII also.
Learned counsel representing the respondent -C.B.S.E., submits that a formal application had to be given by the petitioners, but the same has not been received by the C.B.S.E.
The aforesaid submission has been objected and controverted by learned counsel representing the petitioners by referring to Annexure-7 (at page-31) to the writ petition, which is a communication between the C.B.S.E. and the Principal of Pentecostal Assembly School, Bokaro Steel City, Bokaro, Jharkhand.
Considering the fact that the C.B.S.E. had already made aforesaid corrections in the names of these petitioners in the certificates of Class-X of their ward, I direct the C.B.S.E. to immediately carry forward the corrections in the Admit Card / Transfer Certificate / marksheet of Class-XII of the ward of these petitioners, as has been done in the certificates of Class-X, so that names of guardians of the student namely Shubhi Rupak, be reflected uniformly in the certificates of Class-XII, as it had been shown in the certificates of Class-X.
If any prescribed fee is to be deposited by the petitioners, the C.B.S.E. will demand the same from them, which they will deposit accordingly.
The entire process should be concluded within a period of three months from the date of receipt of copy of this order.
With the aforesaid observation and direction, this writ petition stands disposed of.
