Judgment
This Appeal has been filed against the order dated 08.09.2022 by which various IAs in CP (IB) No. 3025/MB/2019 has been adjourned for 14.10.2022.
Shri Gopal Jain, Learned Senior Counsel for the Appellant submits that the plan approval Application being I.A 2429/2021 is pending since 31.08.2021. He further submits that now the matter has been posted for 02.12.2022.
In view of the fact that the matter has already posted for 02.12.2022, we see no reason to entertain this Appeal. We, however, request the Adjudicating Authority to endeavor to take up the Applications on the date fixed and dispose of the same as early as possible giving some priority to the matter.
Looking to the fact that the Application has come before the Adjudicating Authority on several occasions which is reflected from the order sheets brought on the record of the Appeal, we are of the view that the plan approval Application as well as other pending IAs may be endeavor to dispose of as early as possible preferably within a period of three months from the date this order is produced before the Adjudicating Authority.
The Appeal is disposed of with these observations.
