Judgment
The work of the Tribunal has been closed due to Covid-19 pandemic as per letter dated 22.03.2020 and subsequent follow up orders of the Principal Bench, National Company Law Tribunal. The Principal Bench vide Notice dated 15.06.2020, constituted this Bench for hearing of the urgent matters through Video Conference (VC).
The matter is taken up on Video Conference. Counsels for the Applicant led by Senior Counsel Mr. Ravi Kadam are present. Counsel for the CoC is present and Counsel for the Applicant in IA Nos. 1960 of 2019 and 3055 of 2019 is also present. The present Application is for urgent listing of IA 920 of 2020 [(CP (IB) 1385/MB/2017)]. The parties present submitted that the IA 920 of 2020 filed for approval of Resolution Plan needs to be taken up early for hearing. On such submissions the IA No 1056 of 2020 is disposed of with a direction that IA No 920 of 2020 be taken up for hearing on 05.08.2020 along with IA 1960 of 2019 and IA No 3055 of 2019.
Counsel for the CoC submitted that the CoC (SBI) has also made a similar Application (Filing Ref No. 2700990097152020) for urgent listing of the Plan Approval Application. In view of the above order, the Application may not be numbered and is disposed of.
