The applicant filed O.A. No.1293/2013 claiming the relief in respect of an order of transfer dated 31.12.2012 and for the relief of revision of pay
scale. When the O.A. was taken up for hearing, we perused the record and took note of the fact that the challenge to the order of transfer was not
pressed; and granted the relief as regards the pay scale. It was left open for the applicant to make representation in this behalf, if his grievance
subsists.
Curiously enough, the applicant filed this R.A. Way back on 24.07.2017, the Tribunal passed an order, taking note of the fact that the learned
counsel for applicant is not pressing the relief, i.e., with regard to order of transfer dated 31.12.2012. The same is extracted in the R.A. also. That
being the case, it is just un-understandable as to how he can press that very relief at a later stage. The transfer was effected way back in the year
2012 and the interim order passed on 18.04.2013 virtually stood vacated on 24.07.2017.
The order in the O.A. was passed after hearing the learned counsel for applicant and he was very much aware of the result thereof. The
explanation offered for the delay is not convincing and on merits also, we do not find any ground to entertain.
The M.A. and R.A. are accordingly dismissed.
