MA-830/2020 filed for joining together is allowed for the reasons stated therein.

The applicants were appointed as HMV Drivers on contract basis in the year 2012 and their contract was renewed from time to time by the orders of the competent authority. However, they were paid their due salary/wages by the office of Executive Engineer (RIP), NDMC. The applicants made representation on 13.02.2019 & 18.10.2019 to the respondents with prayer for grant of status of Regular Muster Roll (RMR) w.e.f. April, 2015 regularising them on the post of post of HMV Drivers, but the respondents did not decide their representation.

Learned counsel for the applicants pleaded that respondents have now even stopped the applicant no.2 to perform duties without assigning any reasons.

Learned counsel for the applicants submits that applicants will be satisfied if respondents are directed to decide their representation dated 18.10.2019, which is still pending, by a reasoned and speaking order within a time bound manner.

Ms. Sriparna Chatterjee, learned counsel appears on advance notice on behalf of the respondents and submits that she has no objection if the OA is disposed of with the aforesaid directions.

Accordingly, without going into merits of this case, the OA is disposed of with the direction that if applicants submit a detailed representation to the respondents along with a certified copy of this order within 15 days, the respondents shall decide the same by means of a reasoned and speaking order within a period of six weeks from the date of its receipt, in accordance with the law. No orders as to the costs.
