Heard learned counsel for the parties.
The order-sheet reveals that both the parties were present on 27.06.2022. This court is satisfied on the settlement arrived at between them.
Learned counsel for the State would submit according to the instructions which she has received is that the injured has sustained simple injuries, but as many as 15 cases are pending against him.
However, it is born out from the record that the petitioner is being investigated for the offences under Sections 323, 504, 506, 427 and 147 IPC. Out of the aforesaid offences, only offence under Section 147 IPC is a non-compoundable and the rest are compoundable offences.
Keeping in view the nature of the offences and the injuries sustained by the injured stated to be simple, as also the fact that the parties have amicably settled the dispute out of the Court, and their application for disposal of the writ application on the basis of compromise arrived at between them, the writ application is allowed.
In that view of the matter, the writ application is allowed on the basis of compromise arrived at between the parties. Accordingly, the FIR No. 116 of 2022, dated 19.06.2022, registered at PS Pantnagar, District Udham Singh Nagar, under Sections 147, 323, 504 ,506 and 427 IPC is quashed as per the compromise.
Urgent certified copy of this order be granted on proper application.
