Mrs. Monika Kohli, learned Senior AAG appearing on behalf of the respondents, has produced a communication dated 07.11.2025, which reads as under:
“An appeal titled Ashok Singh & Ors V/s Nagar Singh & Ors is pending before the court of the undersigned against the order passed on mutation No. 1211 on the land bearing Khasra No. 1467/608, situated at village Katli, Tehsil and district Samba. The compensation amount for the land bearing Khasra No. 1467/608, 702 min, 724, 754, 755, 1510/1495/753, 762 min, 757 is already deposited in the Registry of High Court. These Khasra Nos. also overlap with the Khasra No. of the petitioner in application No. CM No. 3385/2025 and 3386/2025.”
Mr. M. A. Bhat, learned counsel for the petitioners, submits that mutation No. 1211 does not pertain to the land for which the petitioners are seeking compensation.
He further submits that the appeal pending before the Collector (Deputy Commissioner), Samba, titled Ashok Singh and others v. Nagar Singh and others, relates only to Khasra No. 1467/608 and mutation No. 1211, whereas the land for which compensation is sought pertains to Khasra Nos. 724, 754, 755, and 757, situated at village Katli, Tehsil and District Samba, which are not the subject matter of the said appeal pending before the Additional Deputy Commissioner, Samba.
Let the respondents file an affidavit clarifying whether the petitioners land falling under Khasra Nos. 724, 754, 755, and 757 situated at village Katli, Tehsil and District Samba, forms part of the subject matter of the aforesaid appeal.
Digital/photocopy record of the aforementioned appeal be summoned.
