The instant writ petition has been filed under Article 226 of the Constitution of India for quashing the order dated 21.10.2025 passed in Criminal Misc. Case 278 of 2025 which was initiated under Section 163 of BNSS, 2023 passed by Sub Divisional Magistrate, Mahagama, District-Godda.
Petitioner was the first party and at her instance the proceeding was initiated by the learned Sub Divisional Magistrate against respondent nos. 5 to 7. The said proceeding was not converted into a proceeding under Section 164 of the BNSS, 2023, but a final order was passed on 21.10.2025, whereby and whereunder, the interim order of status quo passed against both sides was confirmed against the first party while vacating against the second party-respondents.
Aggrieved by the said order the instant writ petition has been filed.
Without going into the merit of the instant writ petition, it is apparent that more than 60 days have elapsed since passing of the order under Section 163 of BNSS, 2023 by the learned Sub Divisional Magistrate and therefore, the order is without any force and non-est in the eyes of law.
Under the circumstance, this writ petition is disposed of as infructuous. Pending I.A., if any, stands disposed of.
