The grievance of the petitioner is that the District Magistrate who is an authority under the Young Persons (Harmful Publication) Act, 1957 and Indecent Representation of Women (Prohibition) Act, 1986 (hereinafter referred to as the Act) is not taking steps to curb the menace of obscene posters, hoardings etc. exhibited in the whole of the State of Bihar. After hearing Learned Counsel for the petitioner and the Learned Counsel for the State, we are issuing direction to the District Magistrates to see that the provisions of the Act are observed and necessary action be taken against the concerned persons. The obscene posters, hoardings etc. should be immediately removed.

It is made clear that if the matter is brought to the notice of the court that no action is taken by the authorities, then this Court will take appropriate action against them.

With the aforesaid directions, the writ application stands disposed of. Let a copy of this order be sent to the Chief Secretary, Govt. of Bihar, Patna with a direction to communicate the said order to all the District Magistrates.
