Judgment
The applicant has filed the present application under Section 18 read with Sections 14 and 15 of the National Green Tribunal Act 2010 complaining about non-compliance with the consent conditions and environmental norms by the respondent.
Vide order dated 27.05.2022, notice was ordered to be issued to the respondent. On service, reply and vakalatnama on behalf of respondent were filed through email dated 29.09.2022.
Interim Application no. 270/2022 for impleading of Uttarakhand Environment Protection and Pollution Control Board and The District Magistrate, Udham Singh Nagar and Interim Application no. 271/2022 for filing supplementary document by way of affidavit have been filed by the applicant.
Vide order dated 02.11.2022, learned Counsel for the respondentHimalayan Food Park was granted time to file reply and personal appearance of the applicant before this Tribunal was ordered.
Reply to I.A No. 270/2022 and I.A No. 271/2022 has been filed by the respondent vide email dated 13.12.2022.
I.A No. 328/2022 has been filed by the applicant for dispensing with personal appearance of the applicant on the ground of his illness.
I.A No. 328/2022 is supported by medical certificate and the same is allowed in view of the nature of illness mentioned and recommendation of the Doctor for bed rest.
