Judgment
Arindam Lodh, J
Heard Mr. S. Lodh, learned counsel appearing for the petitioner as well as Mr. S. Debnath, learned counsel appearing for the State-respondent.
This is an application filed under section 438 Cr.P.C. for granting anticipatory bail to the accused petitioner, namely, Sri Anagh Sasi De, in connection with Kanchanpur PS case no. 2022 KCP 016 registered under sections 201/409/420/467/468/506/34 of the IPC.
The main allegation against the petitioner is that the petitioner being a Branch Manager had sanctioned some loan in favour of the complainants. From the record, it is revealed that both the complainants had received the sanctioned loan amount and the sanctioned money had been credited to their respective accounts. It is also revealed that they have given withdrawal and received the loan amount. It is further revealed that the complainants had repaid the loan amount to the bank. Now, they lodged a complaint that they did not receive the loan amount.
The allegations leveled against the petitioner are based on documentary evidence and according to this court, no custodial interrogation is required.
Thus, I am inclined to release the accused petitioner on anticipatory bail. Accordingly, in the event of arrest, the accused, namely, Sri Anagh Sasi De may be released on bail on executing a bond of Rs. 50,000/- supported by one surety of the like amount, to the satisfaction of the arresting authority. It is informed that as per direction of this court, the petitioner had appeared before the investigating officer and has co-operated with the process of investigation. However, it is directed that the petitioner shall co-operate with the process of investigation in all respects.
With this observation and directions, the instant application stands allowed and disposed of.
