Judgment
Heard Mr. A.K. Sahani, the learned counsel appearing for the petitioner and Mr. R.C.P. Sah, the learned counsel appearing on behalf of the
respondents.
This writ petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due
to COVID-19 pandemic. None of the parties have complained about any technical snag of audio-video and with their consent this matter has been
heard.
The petitioner has preferred this writ petition for a direction upon the respondents to pay arrears and current pension, house rent allowance and the
amount accrued under 7th pay revision in respect of the salary, leave salary and gratuity with interest.
Mr. R.C.P. Sah, the learned counsel for the petitioner submits that the petitioner was appointed on the post of Typist-cum-Clerk on 17.08.1979 in the
Adityapur Industrial Area Development Authority. The petitioner was reitired on 31.01.2016. He submits that the petitioner has filed a representation
on 27.04.2017 for such claim but the same has not been decided as yet. He submits that if the petitioner files a fresh representation, the same will be
decided by the respondent no.2.
In view of the above, the petitioner is directed to file a fresh representation before the respondent no.2 within four weeks.
If such a representation is filed within the aforesaid period, the respondent no.2 shall consider the case of the petitioner in accordance with the rules,
regulations and guidelines within a period of eight weeks thereafter.
It goes without saying that if the claim of the petitioner is found to be true, the benefit of the same shall be released in favour of the petitioner
immediately.
With the above direction, the instant writ petition [W.P.(S) No.1537 of 2020] stands disposed of.
