Judgment
O R D E R
By Mallika Arya, AM.-
At the outset, the learned counsel for the applicant has contended that for redressal of her grievance, the applicant has already preferred repeated representations. The last representation is dated 20.04.2016 (Annexure A-5 of OA) which is pending before the Sr. Divisional Personnel Officer, South East Central Railway, Bilaspur Division, Bilaspur (respondent no. 5) and the applicant would be satisfied, if a direction is given to the Senior Divisional Personnel Officer to decide aforesaid representation in the light of prayer made therein within a specified time.
On the other hand, learned counsel for the respondents has raised objection and submits that no such direction can be given at this stage.
However, Having regard to the innocuous prayer made by the learned counsel for the applicant, the Senior Divisional Personnel Officer (respondent no. 5) is directed to decide the representation of the applicant dated 20.04.2016 (Annexure A-5) by a reasoned and speaking order within a period of 60 days from the date of receipt of certified copy of this order. While deciding the representation of the applicant, the respondent no. 5 shall treat the present Original Application along with the annexures as a part of representation. The applicant is directed to file a certified copy of this order along with copy of Original application as well as all documents before the Senior Divisional Personnel Officer (respondent no. 5) forthwith. A copy of the reasoned and speaking order shall be communicated to the applicant.
With the above direction, the O.A is disposed of.
There shall be no order as to costs.
It is made clear that nothing has been expressed on the merits of the case.
