Judgment
ORDER
This application has been filed by Mr. Amit Goel, the Financial Creditor, seeking the following prayers:-
a)Allow the Applicant to withdraw the present CP IB -1018(ND/2020) and the insolvency proceedings/ CIRP initiated against the Corporate Debtor be allowed to be withdrawn in compliance of the Settlement Terms dated 3.2.2025 and in compliance of order dated 4.2.2025 passed by the Hon'ble Supreme Court of India;
b)Pass any other order(s) that this Hon'ble Court may deem fit.
It is submitted by Ld. Counsel appearing for both the parties that the parties have settled the dispute before the Hon'ble Supreme Court of India in Civil Appeal No. 2661/2022 in case of "Shobori Ganguli Vs. Amit Goel & Ors." and the Hon'ble Supreme Court of India vide order dated 04.02.2025 has passed an order accepting settlement. The relevant paragraphs of the said order are extracted below :-
"…… 5. The statements made in the Settlement Agreement are hereby accepted and treated as an undertaking to this Court.
6.The parties shall abide by all terms and conditions of the Settlement Agreement and comply with the steps to be taken by them according to the timelines specified in the Settlement Agreement.
7.We place on record our appreciation for the sincere efforts put in by the learned Mediator- Ms. Liz Mathew for successful completion of the mediation.
8.List these matters on 25.03.2025 for compliance."
In view of the orders passed by the Hon'ble Supreme Court of India accepting the settlement, the Applicant is permitted to withdraw IB-1018/2020.
IA-847/2025 disposed of.
All the pending interlocutory applications shall stand closed and disposed of in view of this order.
