According to the applicant, registration of these vehicles is in violation of order of this Tribunal dated 11.12.2015, in OA No.21/2014 (Vardhaman Kaushik v. UOI) read with subsequent orders in M.A. No.12/2018 (30.01.2018) and M.A. Nos.1046-1047/2018 (27.07.2018). The said orders have been misused for seeking registration. The applicants have filed W.P. (C) No. 11749/2022 a Writ Petition in the same matter in Delhi High Court which is pending.
We have considered the matter. While we are not inclined to entertain the application in view of pendency of the matter in the High Court and also in absence of any material showing violation of environmental norms and also in absence of latest position under orders of Hon’ble Supreme on the subject of permissibility of registration of BS-IV diesel vehicles. However, without expressing any opinion on merits, we relegate the applicants to their remedy before the Secretary, Transport Department, Delhi Government who may look into the matter after giving opportunity of being heard to the affected parties and take decision within three months.
The application is disposed of.
All pending IAs will also stand disposed of.
A copy of this order be forwarded to respondents by e-mail for compliance. The applicant may also serve the said respondents with paper book and a copy of this order and file affidavit of service within one week.
