Judgment

This application under Section 439 of the Cr.P.C. has been filed for grant of temporary bail to the applicant on the ground that his father has expired on 03.01.2014 and his 13th day ceremony is to be performed on 15.01.2024.
2 . The applicant has been arrested on 16.09.2022 in connection with Crime No.783/2022 by Police Station Dhamnod, District Dhar (M.P.) registered in relation to the offences punishable under Section 294, 34, 436, 307 & 323.
Along with the application, the document as regards death of the father of the applicant on 03.01.2024 has also been filed.
In view of the above, this Court is inclined to release the applicant on temporary bail for a period of seven days from the date of his release. The temporary bail, accordingly, stands allowed and it is directed that the applicant be released on temporary bail for a period of seven days from today subject to verification the factum of death of his father by the trial Court, on furnishing a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) with one solvent surety to the satisfaction of concerned trial Court/committal Court.
The applicant shall surrender before concerned trial Court/Committal Court after expiry of seven days from the date of his release for being committed to custody.
A copy of this order be sent to the Court concerned for compliance.
