Judgment

This is an application under Section 439 of Cr.P.C. filed for grant of temporary bail on behalf of the applicant, who has been arrested relating to FIR/Crime No.250/2023 dated 10.03.2023 registered at Police Station Panagar, district Jabalpur, for the offences punishable under sections 365, 364(A), 323. 324 and 34 of IPC and Section 120-B of IPC. The applicant is in custody since 11.03.2023.
Learned counsel for the applicant submits that grandfather of applicant has expired on 09.08.2023 and his presence is required for performing the last rites and rituals of his grandfather because his father has died and there is no adult member of this family. It is therefore prayed that the applicant may be released on temporary bail.
Learned counsel for the State submit that the factum of death of the grandfather of applicant has been verified and found to be true.
In view of the aforesaid, the prayer for temporary bail is allowed.
It is directed that the applicant shall be released on temporary bail for a period of 15 days from the date of his release upon his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the concerned trial Court. The applicant is directed to surrender before the concerned trial Court on 16th day of his release. Thereafter, the trial Court shall send him to the custody.
I t is made clear that if the applicant fails to surrender on the aforesaid date, the trial Court shall under intimation to this Court take appropriate action for taking him into custody.
With the aforesaid, this M.Cr.C. stands disposed of.
