This is an application for temporary bail moved by the convict undergoing sentence for the purpose of attending after death ceremony of his Uncle who has expired on 17.11.2012. Rule. Learned APP Mr. H.K. Patel waive service of Rule.
The jail report shows that earlier the applicant was released by the authorities and he has reported back in time and has not misused the concession granted by this Court.
Under the circumstances, this application is allowed.
The applicant is released on temporary bail for a period of 10 days starting from the date of his actual release subject to his furnishing personal bond of Rs. 5000 with one surety of like amount to the satisfaction of the jail authority. The applicant shall surrender before the concerned jail authority on expiry of the period. However, it is made clear that in case the applicant miss uses the concession of bail, his bail bond and surety shall automatically stand cancelled and forfeited to the State. Rule made absolute accordingly.
