Judgment
Heard both sides.
Mr.D.Rajaboopathy, learned Government Advocate (Criminal Side) takes notice for Respondents 1 to 4.
The petitioner prays this Court to issue the Writ of Mandamus to direct the respondent 1 to 3 to remove the petitioner's name from History sheet No.2 of 2025 on the file of the 4th respondent by considering the representation dated 21.07.2026 and also in the light of this Court's judgment in Thirumagan Vs. The Superintendent of Police, Madurai District (reported in 2020(2)L.W.) (Crl) 266).
The learned counsel for the petitioner submitted that, though 9 cases were registered against the petitioner, out of which 2 cases were disposed of by acquittal and remaining 7 cases are pending, but there is no conviction against the petitioner. There is no Section 110 of CrPC proceeding or finding against the petitioner and therefore, the petitioner's name is unwarranted. In the light of the above judgment, a direction may be given to the police to remove the petitioner's name from the History Sheet.
The learned Government Advocate (Criminal Side) submitted that, there are 11 cases against the petitioner, out of which 2 cases were disposed, in which the petitioner was acquitted and the remaining 5 cases are pending for trial, 1 case is under investigation and 3 cases are pending for not taking the case on file by the concerned Court, and as of now totally 9 cases are pending. As per the Police Standing Order No.746, provides for opening of History Sheet and maintaining the same, the police is maintaining History Sheet, knowing that the petitioner is involved in more than 11 cases.
The limited prayer in this Writ Petition is to consider the petitioner's representation to remove the petitioner's name. Without going into the merits of this case, the respondent 1 to 3 are directed to consider the petitioner's representation dated 21.07.2026, in the light of the judgment of this Court in Thirumagan Vs. The Superintendent of Police, Madurai District, within a period of 6 weeks from the date of receipt of the copy of the order and take a better decision.
With the above direction, this Writ Petition is disposed of.
