The applicants, herein, are working in various Non-Teaching posts (Junior Secretariat Assistant (JSA) and Senior Secretariat Assistant (SSA)) under Kendriya Vidyalaya Sangthan (in short, KVS). They have been promoted to the post of SSA and Assistant Section Officer (ASO) respectively and posted to a new place.

Directions have also been issued on 17.07.2020 that unless they joined at a new place of posting, they will be debarred for promotion by one year.

Feeling aggrieved, the applicants have preferred the instant OA.

The applicants' counsel also fairly mentioned that four of the applicants have also preferred their separate representations which have not been disposed off. Further, they will be satisfied at this stage, if a direction is issued to the respondents to dispose of their pending representations in a time bound manner.

Matter has been heard. Sh. Padma Kumar S., learned counsel appeared for the applicant and Sh. R. Gowri Shankar appeared as proxy to Sh. S. Rajappa, learned counsel for the respondents.

The OA is disposed of at the admission stage itself, without going into the merits of the case, with a direction to the respondents to dispose of the applicants' representation within a period of eight weeks from the date of receipt of a copy of this order.

The applicants' counsel has also insisted upon grant of the interim relief. The matter pertains to promotion and transfer. The employees can be transferred anywhere in India. It is for Respondent Department to decide the place of posting keeping in view the Administrative exigencies and difficulty being faced by their staff.

Accordingly, Prayer for Interim Relief is without any merit and is rejected.

In view of the aforesaid, OA along with pending MA stands disposed of. No order as to costs.
