Judgment
Per: P. Madhavan, Judicial Member The applicant is presently working as Store Keeper Grade III at Canteen Store Department, Kochi. The Applicant was recruited as daily rated Lower Division Clerk recommended through the Employment Exchange and appointed as L.D Clerk in the Office of CSD Depot on 07.02.1987. He was regularised in service on 30.04.1990. The Applicant has submitted Annexure A-1 representation for getting regularisation his casual service from 07.02.1987 upto 30.04.1990 together with service benefits, but it is not considered so far. Hence the Applicant has
prayed for the following reliefs:-
"(i)to declare that the Applicant is entitled for the regularisation of casual service from 07.02.1987 up to 30.04.1990 in the category of Lower Division Clear with all consequential benefits including fixation of pay and arrears of salary;
(i)to direct the First Respondent take in to account of Annexure - A1 representation and pass Orders within a time frame fixed by this Hon'ble Tribunal; and
(ii)to grant such other further relief's as this Hon'ble Tribunal may deem just, fit and proper in the facts and circumstances of the case."
When the matter came up for consideration, Counsel for the respondents submits that there is a delay in filing the Original Application. But the counsel for the applicant submits that the applicant will be satisfied if Annexure A-1 representation is disposed of, on the basis of relevent Rules, Regulations and Orders, within a time frame.
In view of the limited submission made by counsel for the applicant, competent authority among the respondents is directed to consider Annexure A-1 representation on the basis of relevent rules, regulations and orders passed and pass a speaking order within a period of 4 months from the date of receipt of a copy of this order. It is made clear that the disposal of the representation will not extend the limitation period.
The Original Application is disposed as above at the admission stage itself. No costs.
