Judgment

Heard, learned counsel for the petitioner, Mr. Rakesh Kumar and learned counsel for the State, Mrs. Priya Shrestha, APP.
Learned counsel for the petitioner has prayed for regular bail in connection with Ratu P.S. Case No.06 of 2022 dated 03.01.2022, for the offence registered under Section 366A of the Indian Penal Code pending in the court of learned Judicial Magistrate 1st Class, Ranchi.
Learned counsel for the petitioner has submitted, that it is alleged in the First Information Report by the informant that his daughter aged about 14 years have been taken away by the petitioner and as such, FIR has been lodged.
Learned counsel for the petitioner has further submitted, that date of birth of the victim in Aadhar Card is of the year 2003 i.e. aged about 19 years at the time of occurrence, which has been brought on record as Annexure-2.
Learned counsel for the petitioner has further submitted, that both were major having love affair, who were living in Delhi as husband and wife, as such, petitioner, who is in custody since 21.03.2022 may be enlarged on bail.
Learned counsel for the State, Mrs. Priya Shrestha, APP. has submitted, that victim as per the First Information Report is a minor, as such, petitioner may not be enlarged on bail.
Considering the rival submissions of the parties, it appears that there is love affairs between the parties and as per the document brought on record, victim is a major girl, as such, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each in connection with Ratu P.S. Case No.06 of 2022 dated 03.01.2022 to the satisfaction of learned Judicial Magistrate 1st Class, Ranchi on the following conditions:
(i) One of the bailors shall be the deponent / pairvikar of the present case namely, Alisha Aind, daughter of Lorence Aind, resident of Village – Banhara Fagu Toli, P.S. - Sukhdev Nagar, District – Ranchi, who has furnished photocopy of her UID Card before this Court in the bail application.
Office is directed to send the photocopy of UID Card of deponent along with this order to the court below so as to verify the authenticity of the bailor.
(ii) Another bailor shall be father / mother/ son/ wife / brother / sister of the petitioner.
Accordingly, the instant bail application is allowed.
