Mr. B. Muralidhar, learned counsel appears for the petitioner.
Mr. Tandra Ramesh, learned Assistant Government Pleader for Medical, Health and Family Welfare Department appears for respondent No.1.
Mr. T.Sharath, learned Standing Counsel for Kaloji Narayana Rao University of Health Sciences appears for respondent No.2.
The writ petitioner got a seat in the first phase of counselling for admission to MBBS course in respondent No.3 Medical College as per annexure P2 allotment details. Learned counsel for the respondent No.2-University does not dispute the contention of the petitioner that fee of Rs.23,10,000/- was deposited through RTGS before the cut-off time and date i.e., 21.09.2026 in the account of the respondent No.3 Medical College. However, the petitioner could not reach the college in time for submission of the original documents for completing the formalities of admission.
Learned Standing Counsel for the respondent No.2-University submits that on this exceptional ground, if the seat has not been allocated to any other candidate or carried over to the second phase of counselling, then the petitioner can be accommodated. Otherwise, the petitioner can be allowed to participate in the second phase of counselling.
Learned counsel for the petitioner submits that the petitioner is present at the respondent No.3 Medical College today to compete the admission formalities with his original documents, if the seat has not been allocated yet. He further submits that the second phase of counselling for admission to the Management Quota is going to close today by 4:00 P.M.
In the aforesaid background facts and circumstances, we are of the view that the respondent No.2-University would allow admission of the petitioner in case the seat is not allocated to any other candidate or carried forward to the next phase of counselling because of the exceptional grounds made out on the part of the petitioner. In case, the seat has been allocated to any other candidate, the petitioner be allowed to participate in the subsequent phase of counselling including the second phase of counselling, which is going to close today.
Let this order be communicated to the concerned Medical College by the learned Standing Counsel for the respondent No.2-University immediately.
The Writ Petition is disposed of accordingly. There shall be no order as to costs.
Miscellaneous applications, if any pending, shall stand closed.
