The petitioner has filed the present petition for quashing of FIR No. 74 of 2024, dated 20.3.2024, registered at Police Station Nurpur, District Kangra, H.P., for the commission of offences punishable under Sections 457, 380, 511 and 427 of the Indian Penal Code (IPC) and consequential proceedings arising out of the said FIR based on the compromise effected between the parties.

It has been asserted that the parties have entered into a compromise with the intervention of respectable persons of the society. The informant is related to the petitioner, and they want to maintain cordial relations with each other.

Statement of the informant/victim Rajesh Kumar was recorded on 7.10.2025, in which he s a ed that he had entered into a compromise with the petitioner without any influence from any person. He did not want to proceed further and had no objection in case the FIR is ordered to be quashed based on the compromise effected between the parties.

I ave heard learned counsel for the parties and have one through the records carefully.

The offence punishable under Section 427 of the IPC is compoundable under Section 320 of Cr.P.C. This Court had already quashed the F.I.R. registered for the commission of offences punishable under Section 380 of IPC in Harsh Anand vs. State of H.P. & others 2020 STPL 5681 HP and Musharaf vs. State of H.P. 2022 STPL 9665 H.P., which are binding on this Court.

Therefore, in view of these precedents, the present petition is allowed and FIR No. 74 of 2024, dated 20.3 2024, registered at Police Station Nurpur, District Kangra, H. ., for the commission of offences punishable under Sections 457, 380, 511 and 427 of IPC and consequential proceedings arising out of the said FIR are quashed.

Petition stands disposed f in the above terms, so also pending miscellaneous applications, if any.
