The petitioner has filed the present petition for quashing of F.I.R. No. 147 of 2022, dated 03.12.2022, registered for the commission of offences punishable under Sections 279, 337 and 338 of Indian Penal Code (IPC) at Police Station Lamabagaon, District Kangra, H.P. and the consequential proceedings arising out of it, based on the compromise effected between the parties.
It has been asserted that the parties have entered into a compromise voluntarily without any fraud, coercion , duress or undue influence. The offences are private and personal in nature and do not impact the State. Hence, the present petition.
The statement of the informant-Rakesh Kumar was recorded on 06.07.2026, in which he stated that he had entered into a compromise with the accused voluntarily without any influence from any person and he had no objection for quashing the FIR based on a compromise between the parties.
Statements of victims Malka Devi and Raj Kumari were recorded on 11.08.2026, in which they stated that they had entered into a compromise with the accused voluntarily without any influence from any person and they do not want to proceed further with the matter after the compromise.
I have heard learned counsel for the parties and have gone through the records carefully.
The offences punishable under Sections 337 and 338 of IPC are compoundable under Section 320 of the Code of Criminal Procedure (Cr.P.C.). This Court had already quashed the F.I.R. registered for the commission of offences punishable under Sections 279, 337 and 338 of IPC M.V. Act in Sushant vs State of H.P. 2023 HLC 531, Vikas Huda vs. State of H.P. 2023 STPL 3009, Kulwidner Singh vs Ankush Kumar 2023 HLR 384 and Nishant vs. State 2022 Suppl. Law Cases 45 and others, based on the compromise. These judgments are binding on this Court.
Therefore, in view of these precedents, the present petition is allowed and F.I.R. No. 147 of 2022, dated 03.12.2022, registered for the commission of offences punishable under Sections 279, 337 and 338 of IPC at Police Station Lambagaon, District Kangra, H.P. and consequetional proceedings arising out of it are quashed.
Petition stands disposed of in the above terms, so also pending applications, if any.
Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh before the authorities concerned, and the said authorities shall not insist on the production of a certified copy but if required, may verify passing of the order from Website of the High Court.
