In the present Original Application, the applicant has challenged the notification/final result dated 15.01.2021 (Annexure A-1) vide which the applicant has been declared ‘Not Qualified’. Learned counsel for the applicant argues that in the relevant physical test, the applicant though stood first, however, arbitrarily he has declared not qualified.

Learned counsel for the applicant submits that the applicant has not exhausted the administrative remedy and, therefore, the applicant will be satisfied, if the present OA is disposed of with liberty to the applicant to make a comprehensive representation before the competent authority under the respondents and that competent authority is given a time bound direction to consider such representation.

To such request of the learned counsel for the applicant, there is no objection from the learned counsel for the respondents.

In view of the aforesaid, without going into the merits of the claim of the applicant, the present OA is disposed of with liberty to the applicant to prefer a comprehensive representation for redressal of his grievances to respondent no.3 i.e. Centre for Personnel Talent Management (CEPTAM), DRDO, Ministry of Defence, METCAFE House, Civil Lines, Delhi – 110 054 within ten days from the date of receipt of a copy of this Order and respondent no.3 is directed that if such representation is received from the applicant within the stipulated time herein, the respondent no.3 shall consider and dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within six weeks from the date of receipt of such representation.

The OA is disposed of in the aforesaid terms. No costs.
