Rule. Mr. K.P. Raval, learned Additional Public Prosecutor waives service of notice of Rule on behalf of the respondent No. 1-State. Heard Mr. K.P. Raval, learned Additional Public Prosecutor for the State.

This application is preferred by the convict of offences punishable under sections 363, 366 and 376 of the Indian Penal Code as per judgment dated 19.12.2008 passed in Sessions Case No. 36 of 2008 by the learned Additional Sessions Judge, Vadodara, who seeks temporary bail on the ground to pay fine imposed by the Sessions Court and against which, Criminal Appeal No. 1064 of 2010 filed before this Court, is pending.

On perusal of jail record of the applicant as furnished by the Deputy Superintendent, Vadodara Central Jail, appears to be reasonably good and by imposing suitable conditions, the applicant is ordered to be granted temporary bail for a period of two weeks. The applicant is, therefore, ordered to be released for 15 days from today to pay fine to be paid and the applicant shall furnish a personal bond of Rs. 2,000/- to the satisfaction of the Jail Authority and on completion of the period of temporary bail, the applicant shall return to Jail Authority in time. Accordingly, this application is allowed. Rule is made absolute to the aforesaid extent. No order as to costs.
