The present petition has been filed under Articles 226/227 of the Constitution of India seeking a writ in the nature of CERTIORARI for quashing of impugned amended/modified appointment letters dated 18.09.2019 (Annexure P-5 colly).
The present petition was directed to be heard along with CWP No.28138 of 2019 vide order dated 04.10.2019 and the aforesaid CWP No.28138 of 2019 has been disposed of vide separate order of even date. Therefore, the present petition is hereby segregated from the aforesaid case.
At the outset, Mr. R.K. Doon, learned counsel appearing on behalf of respondents No.2 and 3 has stated on instructions that the services of both the petitioners have already been terminated and since the prayer in the present petition is challenge to the added clause in the appointment letter, nothing would survive in the present petition because the services of both the petitioners have already been terminated.
In view of the above, the present petition is dismissed
Since the learned counsel for the petitioners is not present in the Court today, in case any cause of action survives, then he may file any appropriate application in accordance with law.
