Judgment
Heard both learned counsel for the applicant as well as for the respondents.
Learned counsel for the applicant submits that the applicant has given representations on 20.04.2020 and 06.01.2021 to the respondents raising his grievance with regard to promotion but till date no reply has been received by him from the respondents.
At this stage, learned counsel for the applicant states that the applicant would be satisfied if a direction be given by this Tribunal to the respondents to consider and dispose of the pending representations of the applicant after taking into account the judgment of the Hon'ble Apex Court in the case of UoI Vs. K.V. Jankiraman (AIR 1991 SC 2010) within a stipulated period of time, to which the learned counsel for the respondents' objects.
In view of the above submissions, it is directed to the applicant that he prefer a fresh representation to the respondents within a week from today and respondents are directed to consider and decide the fresh representation of the applicant by passing a reasoned and speaking order as per law within a period of three months from the date of receipt of fresh representation from the applicant. The decision shall be communicated to the applicant forthwith.
It is made clear that no order as to merits of the case have been passed.
Original Application is disposed of accordingly.
No costs.
