Heard the parties.
This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure, 1973 with the prayer to quash the entire criminal proceedings in connection with G. Case No. 296 of 2009, registered for the offence punishable under Section 16 (a) of the Prevention of Food Adulteration Act, 1954 including the order dated 25.03.2009, whereby and whereunder the learned Chief Judicial Magistrate, Hazaribagh has taken cognizance of the Offence punishable under Section 16(a) of the Prevention of Food Adulteration Act, 1954.
It is submitted by learned counsel for the petitioner that the petitioner is not an accused person of the case, and he has no locus standi to file this Cr. M.P.
In view of the submission made by learned counsel for the petitioner, this Cr. M.P. is dismissedbeing not maintainable at the behest of the petitioner,as the petitioner is admittedlyneither the accused personin the case nor he has any locus standi.
In view of the dismissal of this criminal miscellaneous petition, interimorder dated 27.11.2019 passed in this case isvacated.
Registry is directed to intimate the Court concerned forthwith.
