Judgment
Heard Learned Counsel for the Appellant on I.A. No. 2008 of 2021 an application of condonation of delay. We have considered the grounds projected in this Appeal. There is delay of ten days in filing the Appeal after due consideration. The application is allowed and delay is hereby condoned.
Heard I.A. No. 2009 of 2021. An application for exemption from filing the certified copy of the impugned order. Application is disposed of with this condition that whenever the Appellant gets the certified copy of the impugned order he will file the same.
Learned Counsel for the Appellant submits that the Appellant is registered association of homebuyers of M/s Intellicity Business Park Ltd, the holding Company of the Corporate Debtor M/s Ascot Projects Pvt. Ltd. The Appellant is a financial Creditor. Therefore, filed an application for intervention.
However, Learned Adjudicating Authority has erroneously dismissed the application.
Issue notice to Appeal as well as on I.A. No. 2007 of 2021. An application for stay of the proceedings.
Learned Counsel appearing on behalf of the Respondent No.3 and 4 accept notice. They seek and are granted two weeks time to file Reply Affidavit and Reply to the Application. Rejoinder, if any, one week thereafter.
Issue notice to rest of the Respondents i.e. Respondent No. 1, 2,5, 6 & 7 by speed post. Requisites along with process fee be filed, if not filed, within 2 days. If the Appellant provides the e-mail address of the Respondent. Let notice also be issued through e-mail.
Let the matter be fixed 'For Admission (After Notice)' on 28th October, 2021.
