Judgment
ORDER
Heard the Counsel appearing for the Financial Creditor/Petitioner. The above Company Petition is filed by Advanced Computers and Mobiles India Private Limited for initiation of the Insolvency Resolution Process against the Respondent, Parveen Iqbal Parekh who is the personal guarantor of M/s. JSK Marketing Limited (‘Corporate Debtor’).
The Financial Creditor invited attention to the copy of the deed of guarantee executed by the Respondent in favour of the Petitioner dated 15.04.2019. Learned Counsel appearing for the Financial Creditor further invited the attention of this bench to the demand notice (Form-B) dated 18.08.2023, thereby calling upon the Personal Guarantor to pay an outstanding amount of Rs. 1,10,00,000/- (Rupees One Crore and Ten Lakhs only) and also invited the attention of this bench to the proof of service of the demand notice. The Financial Creditor has suggested the name of the Resolution Professional along with the Petition.
After hearing the submissions and upon perusing the above documents, this bench appoints Mr. Manish Sukhani having IBBI Registration No. IBBI/IPA-001/IP-P00668/2017-2018/11137, registered address;- B-213, Orchard Road Mall, Royal Palms, Aarey Colony, Goregaon (East) Mumbai, Maharashtra- 400065 and email Id; [email protected], as Resolution Professional to examine the Petition and file his report within 10 days from the date of the uploading the order. List this matter on 06.12.2024 for submission of the report.
