The learned counsel for the petitioner submits that the complainant is one of the authorized partner of M/s Tara Shankar Traders, Kokar, Ranchi and after the purchase of the land admeasuring about 800 acres situated at Mouza Kute, Thana No.85, Police Station Ormanjhi, District Ranchi was purchased by Shanti Devi vide registered sale deed no.3732 in the year 1941. He submits that the agreement for sale dated 24.09.2018 was executed between the petitioner nos.1, 2, 5, 8, 9 and 12 along with the other co-sharers and M/s Tara Shankar Traders for purchase of the said land and at the time of execution of agreement for sale and amount of Rs.5 lacs (Rs.five lacs) was paid as earnest money to the vendors with the condition that the purchaser would pay the balance amount within one year for execution of registered sale deed. He submits that the said M/s Tara Shankar Traders has not come forward for registration of the land in question and the petitioner has executed the sale deed no.7501 dated 17.11.2021 in favour of M/s Ninety Nine Builders Private Limited for some area. He submits that the allegations were made that pursuant to the agreement with M/s Tara Shankar Traders the said land was not registered in favour of the said M/s Tara Shankar Traders and he is one of the partner of the said M/s Tara Shankar Traders.
Issue notice upon the respondent no.2 by registered post with A/d as well as under ordinary process for which requisites etc. must be filed within one week after Deepawali Vacation.
