Judgment
Prashant Kumar, J.—Anticipatory bail application filed by Petitioners Achutananda Pradhan @ Hori Pradhan, Ashamoni Pradhan @ Asha Pradhan and Jyotsnarani Pradhan @ Jyotsna Pradhan is moved by Sri. Kripa Shankar Nanda and opposed by Sri J. Mahto, learned Additional P.P.
From perusal of FIR, I find that all the occurrence took place in the in-laws house of informant situated at village Gonali ( Gondol), P.S.-Jharpokharia, District-Mayurbhanj in the State of Orissa. Under the aforesaid circumstance, prima facie, it appears that Ghatsila Court has no territorial jurisdiction to try aforesaid case.
Considering the aforesaid facts and circumstance, I allow this application and direct the Petitioners to surrender in the court below by 18.4.2011 and in that event the court below is directed to enlarge the Petitioners, above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand)each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate at Ghatsila in connection with Dhalbhumgarh ( Gorabanda) P.S. Case No. 38 of 2008 ( G.R. No. 411 of 2008) , subject to the condition as laid down u/s 438(2) of the Code of Criminal Procedure.
