Judgment
Per: Hon’ble Mr. Umesh Gajankush, Member (J)
The present original application has been filed by the applicant seeking following reliefs:
“a. Direct the Respondents, in particular Respondent No. 2, to consider and decide, by reasoned speaking orders, all the pending representations of the Applicant detailed in the Chronology in Paragraph 4.6 above, within such time as this Hon’ble Tribunal may fix, preferably within two weeks;
b. Direct the Respondents to pass a specific order under the first proviso to FR 53(1)(ii)(a) of the Fundamental Rules enhancing the Applicant’s subsistence allowance to 75% of pay with effect from 25.03.2026, and to disburse the arrears thereof;
c. Award costs of this application; and
d. Pass such other and further order(s) as this Hon’ble Tribunal may deem fit and proper in the facts and circumstances of the case.”
Applicant before this Tribunal submits that on the basis of registration of CBI case RC No. 2182025A0018 on 26.12.2025, he was arrested and therefore, under Rule (2)(a) of the CCS(CCA) Rules, 1965, applicant was placed under suspension. The said suspension order is continued vide order dated 18.03.2026.
It is the case of the applicant that after initial period of 90 days as per F.R. 53, the respondents are required to increase the suspension amount to the extent of 75 percent. However, in spite of representation dated 01.06.2026, 30.06.2026 and 09.07.2026, neither the representation has been considered nor the amount of suspension allowance has been increased. Therefore, a limited prayer has been made by the learned counsel for the applicant that the Competent Authority of the respondents may be directed to consider and decide the pending representation of the applicant expeditiously.
On the basis of advance copy, proxy counsel for the respondents, Ms. Bhumika Apte seeks time, however, since we are inclined to dispose of the present original application at the Admission stage by directing the respondents to consider the pending representation and therefore, it is not necessary to call upon respondents to file the reply.
Considering the limited prayer made by the learned counsel for the applicant, the present original application is disposed of with the direction to the Competent Authority of the respondents to decide the representation dated 09.07.2026 in accordance with law within a period of 60 days from the date of receipt of certified copy of the order.
We made it clear that we have not gone into the merits of the case.
With the aforesaid, the OA is disposed of. Pending MAs, if any, shall stand disposed of. No order as to cost.
