M.A. No. 1030/2021
This Application is filed with a prayer to condone the delay of 1358 days in filing the OA. The applicant intends to challenge an order dated 17.07.2015. It is in relation to the extension of the benefit of ACP/MACP.
We heard Sh. Tushar Ranjan Mohanty, learned counsel for the applicant and Sh. Satish Kumar, learned counsel for the respondents.
The delay involved is about four years. It is not as if that the applicant was not aware of the order dated 17.07.2015. If he had any grievances about it, he was expected to work out the remedies at the relevant point of time. Not a single reason is mentioned how the applicant was handicapped in pursuing the remedies. The reason behind stipulation of limitation is that the Court or Tribunal cannot be burdened approached with stale proceedings.
Even otherwise the benefit of ACP/MACP can be granted, only after examination of the relevant records and factors. The issue is to be dealt with, at the relevant point of time. This claim is not something akin to pensionary benefits. We do not find any ground to condone such an enormous delay. The MA is accordingly dismissed.
As a result, the OA also stands dismissed. There shall be no order as to costs.
