Judgment
The issue raised in this original application was relating to burning of pet coke and causing pollution by units operating in Pali, Balotra and Jodhpur.
The Tribunal, while disposing of original application by order dated 06.01.2023, had issued following directions:
“xxx ………………………………..xxx……………………………….xxx
With regard to burning of pet coke and causing air pollution, we find that this aspect can also be looked into by the authorities concerned in the said area. We, therefore, dispose of this application by directing State PCB to look into the matter and take appropriate remedial and preventive action in accordance with law within two months.
Action taken report shall be filed with the Registrar General of this Tribunal by 15.04.2023 by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF. If found necessary, the Registrar General shall place the matter before Bench for further directions.
With the above directions, this application is disposed of.”
The action taken report in pursuance to the above direction has been filed disclosing that in the inspection which was carried out by the concerned authority between the period from July 2021 to March 2023, out of 961 industries inspected, only 7 units were found suspected using pet coke as fuel and 5 units were proved utilizing pet coke as fuel. Therefore, action has been initiated against the defaulting units. The report reads as under:

That from July 2021 to March 2023, total 961 No. of industries was inspected by the officials of the State Board. Out of which 07 units were found suspected using Petcoke as fuel and 05 units were proved utilizing Petcoke as fuel. Therefore, the State Board has initiated action against all such defaulting units. The list of defaulting units is attached herewith and marked as Annexure-R/ 1.
That the officials of the State Board also inquired from all authorized dealers of Petcoke and valid users have been taken and all were inquired regarding delivery of Petcoke in Pali but all have submitted that they have not delivered any Petcoke at Pali. It was also informed that the Petcoke is being distributed to authorized vendors with chain linked documents.”
Five defaulting units mentioned in the Annexure R-1 to the report are as under:
i. M/s Shree Padmawati Fab Tex.
ii. M/s Chhajer Textile Mills.
iii. M/s Mahesh Wari & Sons.
iv. M/s Gautam Traders.
v. M/s Gandhi Fab Tex
Since the needful has been done, the defaulting units have been identified and action has been initiated against them, therefore, no further action in this application is required which accordingly stands disposed of.
