Judgment
The present application has been filed by the petitioner against the order dated 10.12.2018 passed by learned Additional Sessions Judge-IV, Gaya in Sessions Trial No.106 of 2016 arising out of Kotwali P.S. Case No.142 of 2004 registered for the offences punishable under Sections 376, 312, 313, 323 and 379 of the Indian Penal Code (in short 'IPC'), whereby and whereunder the application filed u/s 311 of Code of Criminal Procedure (in short 'Cr.P.C'). by informant/petitioner to record the evidence of Medical Officer as well as learned Judicial Magistrate, who has taken statement under Section 164 of the Cr.P.C. of victim girl has been rejected by learned trial court.
It is submitted by learned counsel appearing for petitioner that the examination of Medical Officer and learned Magistrate, who has taken statement under Section 164 of the CrPC of the victim girl is essential for just decision of this case and, therefore, the order of rejection vide order dated 10.12.2018 of petition as preferred under Section 311 of the CrPC is bad in the eyes of law.
It would be apposite to reproduce the impugned order dated 10.12.2018 for better understanding of the case, which is as under:-

राज्य बनाम मो० अफरोज एवं अन्य
10.12.18सूचक के विद्वान अधिवक्ता के ओर से दिनांक 7.12.18 को एक आवेदन दिया गया है जिसकी प्रति अभियुक्त के विद्वान अधिवक्ता को दी जा चुकी है। आवेदन पर उभय पक्षों को सुना।
सूचक के विद्वान अधिवक्ता का कथन है कि यह वाद सुनवाई हेतु लम्बित है, लेकिन पीड़िता का जिस चिकित्सक ने जांच किया था, उसकी गवाही नहीं हो पायी है और सूचक को पता लगा है कि वह औरंगाबाद में कहीं पदस्थापित है। इस वाद में पीड़िता के धारा 164 दंडप्र०सं० के अंतर्गत बयान लेने वाले न्यायिक दंडाधिकारी श्री शिवचंद की भी गवाही नहीं हुई है, जो आवश्यक है। अतः इस वाद में डा० एवं न्यायिक दंडाधिकारी की गवाही हेतु सम्मन निर्गत किया जाए।
अभियुक्त के विद्वान अधिवक्ता का कथन है कि सूचक के विद्वान अधिवक्ता को ऐसा आवेदन देने का कोई अधिकार प्राप्त नहीं है क्योंकि यह आवेदन न तो अभियोजन द्वारा दिया गया है और न ही अभियोजन के स्वीकृति के आधार पर दिया गया है। आगे विद्वान अधिवक्ता का कथन है कि यह वाद वर्ष 2004 में संस्थित किया गया है और तब से इस वाद का अभियुक्त लगातार विचारण का सामना कर रहा है जो घोर मानसिक परेशानी से गुजर रहा है। इस वाद में सूचक सहित कुल 5 साक्षियों का गवाही हो चुका है तथा इस वाद में अभियोजन की अंतिम गवाही दिनांक 8.9.16 को हुआ है तत्पश्चात् अभियोजन साक्ष्य बंद कर अभियुक्तों का बयान अंकित किया गया है। इसके बाद बचाव पक्ष की ओर से कुल 3 साक्षियों का साक्ष्य कराया गया है जिसमें अंतिम साक्षी का साक्ष्य दिनांक 24.1.17 को हुआ है और तब से यह अभिलेख लगातार बहस हेतु चला आ रहा है, लेकिन सूचक के विद्वान अधिवक्ता येन केन प्रकारेण अभियुक्त को परेशान करने के लिए वाद को विलम्बित रखना चाहते हैं, जो किसी प्रकार से न्यायोचित नहीं कहा जा सकता। इन्हें ऐसा आवेदन देने का बहुत पहले ही पर्याप्त अवसर दिया जा चुका है। आज भी साक्षियों का कोई स्पष्ट पता अंकित नहीं है, अतः इनका आवेदन खारिज कर इस वाद में बहस सुनकर निर्णय पारित किया जाए।
उभय पक्षों को सुनने के बाद अभिलेख का अवलोकन किया। आदेशफलक के अवलोकन से मैं अभियुक्त के विद्वान अधिवक्ता के कथन को पूर्णतः सही पाता हूँ यह आवेदन निश्चित रूप से गलत आशय के साथ वाद को विलम्बित रखने हेतु दाखिल किया गया है। इस वाद में सूचक के विद्वान अधिवक्ता द्वारा पूर्व में पदस्थापित पीठासीन पदाधिकारी के विरुद्ध एवं अभिलेख के अंतरण हेतु विद्वान जिला एवं सत्र न्यायाधीश, गया के बाद माननीय उच्च न्यायालय, पटना में आवेदन दाखिल किया गया था जिसे आधारहीन पाते हुए माननीय उच्च न्यायालय द्वारा आपराधिक विविध वाद सं० 8217/18 में दिनांक 21.2.18 को अंतरण का आवेदन खारिज कर दिया गया है। वैसे भी यह आवेदन अपर लोक अभियोजक की ओर से नहीं दिया गया है, उस आधार पर भी खारिज किये जाने योग्य है दूसरे इस वाद में इस तरह के आवेदन देने का कोई औचित्य आवेदन में दर्शित नहीं किया गया है।
अतः उपरोक्त तथ्यों के आलोक में वाद के लम्बे समय तक लम्बित रहने की स्थिति को देखते हुए सूचक का आवेदन स्वीकार किये जाने योग्य नहीं है, अतएव सूचक का आवेदन दिनांक 7.12.18 खारिज किया जाता है तथा उभय पक्षों को निर्देश दिया जाता है कि अगली तिथि को बहस हेतु तैयार आवे।

It is submitted by learned APP that the record is at the stage of argument and sufficient opportunity was given by the learned trial court to produce the witnesses. It is submitted that even on the date of hearing, the application was filed without supplying the correct address of the doctor. Still this matter is pending at the stage of argument since last eight years.
Taking note of aforesaid fact, as the provision of Section 311 of the CrPC is for just decision of the case, which nowhere authorized the informant to delay the trial for any indefinite period and, that too, at final stage of argument, accordingly, the present application stands dismissed, being devoid of any merit.
It is directed to the learned trial court that as this matter is pending at argument stage since last eight years, same be conclude within next two months from the date of receipt of a copy of the order.
