Judgment
The writ petition is admitted to hearing and with the consent of learned counsel for the parties, the same is heard finally. In this writ petition, the
petitioner has sought following reliefs:
a) Commanding the respondents to permit the petitioner to work a ration dealer/fair price shop dealer for the village Kunderdan tehsil Chassana
District Reasi without causing any hindrance as the petitioner is providing ration to the ration tickets strictly in terms of Govt. Order No. 127-FCS
& CA of 2016 dated 04.08.2016.
b) Commanding the respondents to strictly adhere to policy issued vide Govt. Order No. 127-FCS &CA of 2016 dated 4.8.2016 as directed by
this Court in its judgment dated 27.07.2017 passed in OWP no. 687/2017 and OWP No. 1885/2016.
When the matter was taken up today, learned counsel for the petitioner submitted that the controversy involved in this writ petition is squarely
covered by judgment dated 27.07.2017 passed by a Bench of this Court in OWP No. 687/2017.
In view of the aforesaid decision and in the facts of the case, this writ petition is disposed of with a direction to the the respondents that while
opening fresh/new fair price shops, Government order No. 127 FCS &CA of 2016 dated 04.08.2016 shall be strictly adhered to and the ration
tickets of the existing ration dealers shall not be reduced below 250.
With the aforesaid directions, the writ petition is disposed of.
