Petitioner has approached this court aggrieved by the proceedings initiated against him for recovery of amounts due under a loan transaction to which
the petitioner was a surety. Principal debtor committed default and proceedings were initiated for recovery of the money. Pursuant to Ext.P1 notice,
petitioner approached the authority seeking time to repay the money. Thereafter, the petitioner approached this court for direction to respondent to
consider Ext.P2 and to stay the proceedings pursuant to Ext.P1. Ext.P1 is a mere notice intimating the petitioner about the default and requesting him
to re-pay the money. It is only a prelude to coercive steps. Petitioner was called upon to remit a sum of Rs.50,000/- by order dated 25/3/2021, to show
his bona fide. However, in spite of several chances given, petitioner has not remitted the above amount.
In the above circumstances, I find no bona fides in the request made by the petitioner. No relief is liable to be granted to the petitioner in the above
circumstances at this stage. The writ petition fails and is dismissed.
