The petitioner has filed this writ petition challenging Ext.P1 demand notice for recovery of loan on the basis of Arbitration Award obtained by the 2nd respondent.
On the basis of the submission made by the learned counsel for the petitioner that the petitioner is ready and willing to clear the arrears in reasonable instalments, this Court passed an interim order dated 01.03.2024 granting stay of Ext.P1 for a period of six weeks on condition that the petitioner remits an amount of Rs.10,000/- within a period of one month therefrom. On 01.04.2024, this Court noted that the interim order had not been complied with, and, at the request of the learned counsel for the petitioner the case was adjourned for taking instructions. On 12.04.2024, the learned counsel for the petitioner submitted that the petitioner could not remit the amount within the directed time as he was hospitalised and when he attempted to remit the amount later the 1st respondent did not accept the same. Taking note of the said submission, on 12.04.2024 this Court ordered the petitioner to pay the amount of Rs.10,000/-before 5 p.m on that day and it is further made clear that, if the amount is remitted, the interim order will continue for a further period of six weeks.
The matter came up before me on 21.05.2024 and 22. 05.2024 and the learned counsel for the respondents confirmed that the directed amount has not been paid. The case was adjourned to today on the submission of the petitioner that he could not contact his client and seeks time to verify whether the directed amount is paid or not.
Since no valid contention is raised against Ext.P1, this writ petition is dismissed.
