Judgment
Grievance in this application is against illegal construction in Village Sikhopur, Tehsil and District Gurugram by M/s Vatika Ltd, Gurugram. According to the applicant, the project in question has not yet been granted requisite EC. Thus, according to the applicant, construction of the project is without prior EC, in violation of Notification dated 14.09.2006.
Vide order dated 12.04.2022, the Tribunal sought a factual report from a joint Committee comprising of SEIAA Haryana, State PCB and District Magistrate, Gurugram.
Accordingly, report dated 19.7.2022 has been filed on behalf of the joint Committee after undertaking visit to the site and mentioning the stand of the Project Proponent that it was compliant, which is disputed by the applicant.
During the hearing, it is stated by a learned Counsel for SEIAA, Haryana that the SEIAA, Haryana has concluded hearing on the subject and order is reserved.
In view of above, we dispose of the matter without expressing any final opinion in the matter so that SEIAA, Haryana takes decision in the matter on merits, in the first instance.
The application is disposed of.
