Judgment
This M.A. is registered on the basis of the report submitted in pursuance to the direction of the Tribunal dated 20.02.2023 passed in O.A. No. 876/2022. In that OA, registered on the basis of the letter petition, the complaint was made that Fajar Mohammad and Miaz Mohammad sons of Yamine were running a dairy in the residential area at Village Teodhi causing pollution and creating health hazard. The Tribunal by the order dated 20.02.2023, had constituted a joint Committee with a direction to the Committee to look into the compliant, visit the site, collect relevant information and if violation is found, take appropriate action, with the further direction to the Committee to submit the report with the Registrar General of the Tribunal.
The joint Committee has submitted the report on 13.09.2023 with the Registrar General stating as under:-
“(iv) At the time of inspection, it was found that due to the operation of dairy unit, there may be an adverment effect of health on local residence. So in the basis of observation during said inspection notice have been issued to both the dairies by RO, UPPCB, Ghaziabad from this office. Copy of the issued notice are being annexed here with as Annexure 1 & 2.
(v) At the time of inspection food department and GST department license were presented by way of notarized affidavit the diary owners put up there commitment that the dairies shall be sifted at the proper place away from population with in two months. Copies of affidavit as follows are being annexed here as Annexure 3 & 4.”
Since, the needful has been done for shifting the dairies in question and notarised affidavit of the dairy owner in this regard has already been taken, therefore, no further action is required. The authorities are expected to ensure due compliance of shifting of dairies on above term.
M.A. is accordingly disposed of.
