Judgment

Prayer in this writ petition is for issuance of a writ of mandamus directing the respondents to grant fifteen days emergency leave to the petitioner's husband, namely, Ashok Kumar, son of Ramu, aged 43 years, confined at Trichy Central Prison, to participate and make arrangements for their daughter A.Gunasree's marriage, which is scheduled to be held on 13.09.2026.
Today, when the matter was taken up for hearing, Mr.D.Venkatesh, learned counsel Additional Public Prosecutor appearing for the respondents, submitted that the representation dated 08.09.2026 submitted by the petitioner has been considered by the second respondent and the petitioner's husband / convict prisoner has been granted three days emergency leave with police escort vide proceedings bearing No. 500467/Tha.Ku.4/2026, dated 09.09.2026 and produced a copy of the said proceedings before this Court to that effect.
In reply, learned counsel for the petitioner submitted that the respondents have granted three days emergency leave with police escort to the petitioner's husband / convict prisoner. As the leave is sought for the convict prisoner to attend his daughter's marriage, the presence of police escort to her husband / convict prisoner during the marriage ceremony, will cause unnecessary embarrassment to his family members. Therefore, learned counsel for the petitioner prays this Court to grant leave to the convict prisoner without police escort. He would further submit that the convict prisoner, on the earlier occasion, was granted only one day emergency leave with police escort. Hence, he would seek for grant of emergency leave to the convict prisoner for six days.
Taking into consideration the facts and circumstances of the case on hand that the petitioner has sought the grant of leave to her husband for attending their daughter's marriage ceremony, which is scheduled to be held on 13.09.2026 and further since the presence of police escort will cause unnecessary embarrassment to their family members during the marriage ceremony and on the earlier occasion, the convict prisoner was granted emergency leave for only one day, we are inclined to direct the respondents to grant six days emergency leave without police escort to the petitioner's husband / convict prisoner.
Accordingly, the writ petition is disposed of with the following directions:
The respondents are directed to grant six days emergency leave to the petitioner's husband, namely, Ashok Kumar, son of Ramu, aged 43 years, without police escort, from tomorrow i.e., 11.09.2026 onwards.
During the said leave period, he shall report before the third respondent - Police Station, daily at 06.30 p.m., without fail.
He shall report back to the second respondent, on completion of the leave period, without fail.
The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities.
During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
The convict shall utilize the leave only for the reason for which it has been granted and shall not partake in any other activities
No costs.
