Judgment
D. Hariparanthaman, J.—The petitioner is working as Assistant in the third respondent Bank. The grievance of the petitioner is that he has not been regularised in the service though others were regularised. The petitioner has made a representation dated 13.11.2012 to the second respondent to absorb him in the regular establishment of the third respondent bank. Thereafter, he has filed this writ petition, seeking for a direction to the first respondent to consider his representation dated 13.11.2012 regarding regular absorption in the 3rd respondent bank.
For more than one reason, the writ petition deserves to be dismissed. Though the prayer is for a direction to the first respondent viz., Registrar of Cooperative Societies, to issue a direction to absorb him in the third respondent bank, essentially, the prayer is against the third respondent Bank.
It is well settled that the Writ Petition against the Cooperative Society is not maintainable as held by the Full Bench judgment of this Court in K. Marappan Vs. The Deputy Registrar of Co-operative Societies and The Special Officer, Vattur Co-operative Agricultural Bank, and the remedy available to the petitioner is to file revision petition u/s 153 of the Tamil Nadu Cooperative Societies Act before the concerned authority. Hence, the Writ Petition fails and the same is dismissed. However, the petitioner is at liberty to approach the revisional authority, if he is so advised. No costs.
