Nagamuthu, J.—The petitioner is a Secretary of C. 2553 Kommasewaram Primary Agricultural Co-operative Credit Society Ltd., which is a Co-operative Society governed by the Tamil Nadu Co-operative Societies Act. The President of the said Society based on the resolution passed in the society, has placed the petitioner under suspension from service with effect from 09.06.2014. Challenging the same, the petitioner is before this Court with this writ petition.

This writ petition has come up today for admission. Mr. L.P. Shanmugasundaram, learned Special Government Pleader takes notice for the respondents.

I have heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and I have also perused the records carefully.

When a specific query was made to the learned counsel for the petitioner as to how this writ petition is maintainable as against the fourth respondent in view of the law laid down by a Larger Bench of this Court in K. Marappan Vs. The Deputy Registrar of Co-operative Societies and The Special Officer, Vattur Co-operative Agricultural Bank, , the learned counsel for the petitioner has got no answer for the same.

As per the settled law in K. Marappan case (cited supra), in my considered opinion, since, the fourth respondent is a co-operative society governed by the Co-operative Societies Act, this writ petition is not at all maintainable and therefore, the same is dismissed however, it is open for the petitioner to work out his remedies in the manner known to law. No costs. Consequently, connected miscellaneous petitions are closed.
