Judgment
Delay Condonation Application (I.A. No. 01 of 2025)
The appeal is reported to be beyond time by 04 days. Counsel for the respondents has no objection to condonation of delay. Accordingly, delay is condoned. Delay Condonation application is allowed. Office is directed to allot a regular number to the instant appeal.
SPECIAL APPEAL NO. 444 OF 2025
The present intra-court appeal is directed against the order of learned Single Judge dated 19.11.2025, by which the writ petition filed by the appellant has been dismissed. The said order is as follows :
“Mr. Vinodanand Barthwal, Advocate for the petitioner.
(2)Petitioner has challenged orders dated 9.2.2011, 21.6.2012 and 11.7.2012 passed by respondent no. 3. By these orders, punishment was imposed upon the petitioner.
(3)There has been delay of more than 14 years in challenging the first order dated 9.2.2011. Similarly, other orders were also passed some 13 years ago. Thus there is inordinate and unexplained delay of more than a decade.
(4)This Court is not inclined to entertain this writ petition at this belated stage. Accordingly, writ petition is dismissed on the ground of delay and laches.”
Learned counsel appearing for the contesting respondents has placed before us an order passed in one of the previous writ petitions filed by the appellant (WPSS No. 647 of 2023) to show that the said writ petition was dismissed on merits. Copy of the said order was not annexed by the appellant along with the writ petition, nor with the present appeal.
Mr. Vinodanand Barthwal, counsel for the appellant, after making submissions at some length states that he is not pressing the appeal.
The appeal is, accordingly, dismissed as not pressed.
